Description: Austin Giacomo, a minor by and through his parents, Mandi Giacomo and Steve Giacomo sued Conner Mercer on a person tort claiming:

1. This action is the result ofan automobile accident that occurred in Oi lahorna County, Oklahoma; the Plaintiffs reside in Oklahoma County; the Defendant resides in Oklahoma CoLinty. This Court has proper jurisdiction and venue over this matter.

2. On September 10,2010, the Defendant was operating a vehicle near Ridgecrest Road and Bryant Avenue when he lost control and caused the accident.

3. Austin Giacomo suffered personal injuries requiring medical cai e and treatment, which was paid for by Jack Roberts and Amber Roberts, his parer Es.

4. As a direct result of the negligence of the Defendant, the minor sulfered injuries for which he received treatment.

WHEREFORE, for the reasons stated above, Plaintiffs, Austin Giacorno, a minor by and through his parents, Mandi Geicoino and Steve Gaicomo, move this Court for judgment against the Defendant, Conner Mereer, in the amount of One Hundred Eighty-Eight Thousaid and No/100 Do]Iars ($188,000.00), plus all other relief the Court deems just and equitable.

Outcome: ON this 6th day of February, 2013, the above styled and numbered cause comes on for hearing, being set specially and it being agreed to waive ajury and try the issue before the Court; the Plaintiffs, Austin Giacorno, a minor, by and through is parents Mandi Giacomo and Steve Giacomo, appear in person, and by and through counsel, Bryan Garrett; and the Defendant, Shelly Marie Richison, being present by and through her counsel of record, Chris Harper, Inc. The Court, having heard the testimony of witnesses, argument of counsel and being fully advised in the premises, finds as follows:

The Plaintiff, Austin Giacomo, is a minor, date of birth September 22, 1995, under the age of eighteen (1 8) years, and brings this action by and through his parents, Mandi Giacomo and Steve Giacomo; the Court finds the issues in favor of the Plaintiff, Austin Giacomo, a minor, and against the Defendant, Conner Mercer, and fixes their recovery at $188,000.00. The Court further finds that Mandi Giacomo and Steve Giacomo, as parents of the minor Plaintiff, Austin Giacomo, are the proper persons to execute any release in satisfaction of this judgment and to receive any money paid thereon for the use and benefit of the minor Plaintiff.
