Description: Carson Jay Spies sued Jacob Steven Valentine on an auto negligence theory claiming:

1. On or about May 26, 2011, Carson J. Spies was a passenger in a motor vehicle driven by Jacob Steven Valentine east bound on Post Oak Road, east of 96th Avenue SE in Cleveland County, Oklahoma.

2. At this time and place, Jacob Steven Valentine recklessly operated his 2001 Ford F-i 50 pickup truck at a high rate of speed, traveled left of the center line into the west bound lane, overcorrected to the right and began sliding at which time the vehicle left the roadway and rolled, coming to rest on its wheels on the south side of the roadway.

3. As a result of Jacob Steven Valentine’s reckless and negligent operation of this vehicle, Carson Jay Spies received physical injuries requiring medical treatment the cost of which is not less than One Thousand Eight Hundred and Thirty Nine Dollars.

4. In conjunction with his physical injuries, Carson Jay Spies has suffered economic damages in the amount of not less than One Thousand Dollars.

5. In addition to these losses and injuries, Carson Jay Spies has endured pain, immobility and emotional distress as a direct result of this traumatic event, for which he is entitled to compensation.

WHEREFORE, the Plaintiff, Carson Jay Spies is entitled to compensation from Jacob Steven Valentine in an amount not less than Ten Thousand Dollars, his costs in this action, including a reasonable attorneys fee, with such other and further relief as to the Court may seem just and proper.

SECOND CAUSE OF ACTION

6. The Plaintiff incorporates the allegations contained in Paragraphs 1 through

5 as though set forth in full.

7. The 2004 Ford F-iso pickup truck operated by Jacob Steven Valentine on or about May 26, 2011 was at that time owned by or under the control of Sandy Valentine.

8. Sandy Valentine knew or should have known that Jacob Steven Valentine should not be permitted operate the vehicle, and as a result of her negligence, Carson J. Spies received his injuries.

WHEREFORE, the Plaintiff, Carson Jay Spies is entitled to compensation from Jacob Steven Valentine in an amount not less than Ten Thousand Dollars, his costs in this action, including a reasonable attorneys fee, with such other and further relief as to the Court may seem just and proper.

Defendant did not file an answer.


Outcome: COMES NOW the Plaintiff, by and through counsel, and dismisses the above captioned cause with prejudice to further litigation pertaining to all matters involved therein, and states that a compromise settlement covering all claims involved in the above captioned cause has been made between the parties.
