Description: Lester Layne Kent sued the Payne County, Oklahoma Sheriff and others on medical negligence theories claiming that substandard medical care provided to him while in custody injured him.

Defendants moved to dismiss.

Outcome: This matter comes on for hearing on April 5, 2012 on Defendant Payne County Jail’s Motion to Dismiss. Plaintiff appears pro se and Defendant appears through its attorney, Andy A. Artus of the firm Collins, Zorn & Wagner, P.C. Upon reading the brief and hearing oral argument, the Defendant’s Motion is granted. The Court finds that it does not have jurisdiction to hear this matter as the notice provision and required waiting period has not passed. Furthermore, the Court finds that the Payne County Jail is not a properly named legal entity that can be sued. As such, this case is dismissed without prejudice to re-filing.
