Plaintiff, Charlene Lovell, for her cause of action against the Defendant, alleges and states as follows:
I. On or about August 25, 2010, Charlene Lovell was stopped at the traffic signal on W. Memorial Rd at N. MacArthur Blvd. in Oklahoma County.
2. Lacey Goodwin was stopped directly behind Ms. Lovell at the traffic signal on W. Memorial Rd at N. MacArthur Blvd. in Oklahoma County.
3. After the traffic signal turned green, Ms. Goodwin drove her vehicle into the rear-end of the vehicle driven by Ms. Lovell.
4. As a direct result of the collision, Ms. Lovell suffered multiple injuries.
5. Ms. Lovell has no fault in this collision. Defendant was negligent in one or more of the following particulars, including but not limited to:
a. Failure to devote full time and attention to her vehicle; and
b. Following too closely.
6. Defendant violated 47 OS. § 11-310 and is guilty of negligence per-se.
7. As a direct result of the negligence of the Defendant, Ms. Lovell suffered damages in excess of the sum of Seventy-Five Thousand Dollars ($75,000). Plaintiff claims damages for the physical pain and suffering, past and future; mental pain and suffering, past and future; permanent injury, lost wages, loss of earning capacity and for the reasonable and necessary medical expenses, past and future.
WHEREFORE, Plaintiff Charlene Lovell prays for judgment against the Defendant in an amount in excess of Seventy-Five Thousand Dollars ($75,000), and for costs, attorney fees, and such further relief to which she is entitled.
Outcome: Settled and dismissed with prejudice.
