Description: Edmond (Oklahoma City) personal injury lawyers and Eugene Bertman successfully represented Plaintiff, John Baldwin, against Tom, Ed and Bill Baldwin for undue influence over his father to exclude John from his father's estate plan and for undue influence regarding the inter vivos transfers of the estate of their father, Charles B. Baldwin. The inter vivos transfers result in the entire estate of Charles B. Baldwin being distributed to his three bothers prior of Charles' death, which was contrary to the specific intent stated in Charles' wills and trust. John Alleged that his three bothers coerced thier father into make a multitude of financial changes to obtain their father's entire estate pre-death and these changes served the dual propose of preventing John from sharing in these assets.

Plaintiff further alleged that the brothers fraudulently represented or misrepresented to John that under certain circumstance, he could be put back into his father's estate all the while knowing they were stripping their fathers's state of all its assets which that there was no estate for John to be put back into and hiding their father from John to keep john from having any contact with his Father. In 2008 and 2009, the Baldwin's family home and its contents were sold, all of Charle's financial assets were prematurely liquidated and ownership of his entire estate was transferred to the defendants. Charles was moved into housing for the elderly where he died approximately two years later.

Defendants denied wrongdoing.

On May 11, 2012, the Court entered an Order in the Case granting relief in favor or Plaintiff and against the Defendants, including an award for monetary relief in the amount of $126,123.00 against each of the Defendants, severally. In additional thereto, the Court awarded an equitable lien on a certain automobile and other property specified in the Order, and the Plaintiff concurrently filed in the Case a motion to assess attorneys' fee, pre-judgment interest, post-judgment interest and costs.

Outcome: Settled for $550,000.00.
