COMES NOW the Plaintiff, Gary L. Free, by and through his attorneys of record, Garrett Law Office, P.C., and for his cause of action against the Defendant, Kimberly R. Mobly, alleges and states as follows:
JURISDICTION AND VENUE
1. That the Plaintiff is a resident of Moore, Cleveland County, State of Oklahoma. That Defendant is a resident of Moore, Cleveland County, State of Oklahoma. That the automobile accident giving rise to this action occurred in Moore, Cleveland County, Oklahoma, thus making jurisdiction of this Court just and proper.
FIRST CAUSE OF ACTION
2. That on July 24, 2009, the Plaintiff was stopped at a red light in the left turn lane at the intersection of Northwest 12thi Street and Janeway. The Defendant was operating a vehicle traveling in an easterly direction on Northwest 12th Street. Upon Plaintiff’s traffic light presenting a green arrow, he proceeded to make a left hand turn. Defendant failed to stop at the red light traffic signal and entered the intersection and carelessly, recklessly and negligently collided with the Plaintiffs vehicle.
3. That by failing to stop Defendant did commit negligence per se.
4. That as a direct and proximate result of Defendant’s negligence and negligence per se, the Plaintiff suffered serious bodily injuries, has endured and continues to endure both physical and mcntal pain and suffering, has incurred lost wages in the past and will incur loss of earning capacity in the future, has incurred and continues to incur medical expenses, has lost the enjoyment of life, and has suffered further damages all of which will be more particularly proven at trial and which entitle the Plaintiff to collect a sum in excess ofSlO,000.OO from the Defendant.
