Description:
Plaintiff was a passenger in a January 2001 2-5 mile an hour rear end accident with disc disruption at the L-4-5 (he was in the front car). Stipulated liability by the Defendant. Defense was pre-existing degenerative disc disease and prior back pain (Framjee). There was a dispute as to any damage to either vehicle but the estimates at the scene were $200.00 to the jeep that hit my client and $400 to the client's vehicle. Plaintiff had another accident in 1991 wherein cervical problems resulted. Prior low back pain, but shifted after the accident and a lumbar fusion eventually resulted. Jury bought the pre-existing argument and gave a -0- verdict. Our experts (via video) were Mike Royal, M.D. treating pain specialist and Dr. Steven Anagnost the orthopedic that did the fusion and later did a second surgery to remove the metal. Two surgeries and about $150,000.00 in overall medical.
Client lost a business that he and his partner were grossing over $600,000.00 per year and filed bankruptcy last fall.
Outcome: Plaintiffs' verdict for zero dollars.
