Description: Julie Kennedy broke her left ankle in 1999 and sought treatment for the fracture from Dr. Robert Shackelford in Cushing, Oklahoma. The fracture did not heal property and she was left with a floating bone in her ankle. Dr. Shackelford recommended that Mrs. Kennedy allow him to operate on the ankle and remove the offending bone to which she consented. When she awoke from the surgery she complained of pain in the wrong ankle. Dr. Shackelford admitted that he had operated on the wrong ankle and asked for permission to perform surgery on the other ankle to which Mrs. Kennedy consented. She developed chronic depilating pain in the right ankle as a result of the operation performed on wrong ankle.

Outcome: Plaintiffs' verdict for $2.5 million.
