Description: McKinleyville, CA - Jury Awards Mother of Homeless Man $2.5 Million On Wrongful Death Claim

Stephany Borges, the mother of Daren Ethan Borges, ate 42, sued Humboldt County and others on civil rights violation theories under 42 U.S.C. 1983 claiming that her son died in the Humboldt County jail in 2014 as a result of the actions by three county jailers who were not property trained by the county and, as a direct result, he died shortly after being placed in a sobering cell. Plaintiff claimed that the jailer failed to have Borges properly evaluated by a nurse with the result they did not know that he was was dying from alcohol and meth intoxication.

The defenses asserted by the defendants are not available.

Outcome: Settled with California Forensic Medical Group for $250,000 and Plaintiff's verdict for $2.5 million.
