Description:

William Gregory and David Haas sued the City of Tulsa and others on a civil rights theory, 42 U.S.C. 1983, claiming that their First and Fourth Amendment rights were violated by City of Tulsa Police Officers who raided the Affinity News store in Tulsa in 1998 and confiscating the lion's share of the merchandise of the store. The City claimed that Plaintiffs were selling copies of Penthouse magazine that were obscene. All charges against Plaintiffs were eventually dropped by the Tulsa County District Attorney after a jury returned a defendant's verdict in another case where a store clerk was charged with selling the same or similar issues of the same magazine.

The defenses asserted by the City are not available at this time.

Outcome: Settled for $65,000.00.
