Philippe Holland, age 20, sued Mitchell Farrell, Kevin Hanvey and City of Philadelphia on civil rights violation theories under 42 U.S.C. 1983 claiming that Farrell and Hanvey used excessive force when they shot and wounded him as he drove away from the place where he had delivered a hamburger.
Farrell and Hanvey were plain clothed Philadelphia police officers who were dispatched to investigate a shots fired report.
Holland drove away thinking that the officers fearing who they were.
The shot him with the result that part of his face is paralayzed.
The defenses asserted by the officer and the City are not available.
