Case Number: 1:2022cv05385

Judge: Vernon S. Broderick

Court: United States District Court for the Southern District of New York (Manhattan County)

Plaintiff's Attorney: Paul Nunes

Defendant's Attorney: Jeffrey S. Jacobson, Justine M. Ginter, Sarah L. Brew

Description: New York City, New York personal injury lawyer represented Plaintiff who sued Defendant on a product liability theory.

"Carol Ann Ready v. Daily Harvest, Inc. was a lawsuit filed in the United States District Court for the Southern District of New York on June 26, 2022. The plaintiff, Carol Ann Ready, alleged that she suffered liver damage after consuming Daily Harvest's French Lentil + Leek Crumbles. Ready claimed that the crumbles were contaminated with a toxin called phoratoxin, which can cause liver damage.

Daily Harvest denied the allegations, stating that the French Lentil + Leek Crumbles were safe to eat. The company also argued that Ready's liver damage was caused by a pre-existing condition.

The case was voluntarily dismissed by Ready on August 3, 2022. The terms of the dismissal were not disclosed.

The case of Carol Ann Ready v. Daily Harvest, Inc. is one of several lawsuits that have been filed against Daily Harvest over the French Lentil + Leek Crumbles. The FDA has also investigated the product, and is currently conducting a criminal investigation into the matter.

It is still too early to say what the outcome of these lawsuits will be. However, the cases have raised serious questions about the safety of Daily Harvest's products, and the company's handling of the French Lentil + Leek Crumbles recall.

Carol Ann Ready claimed that the French Lentil + Leek Crumbles she purchased from Daily Harvest< Inc. were defective and unreasonably dangerous and caused her to be hospitalized.

French Lentil + Leek Crumbles were a frozen food product from Daily Harvest that was recalled in June 2022 due to reports of illness. The product was made with French lentils, leeks, butternut squash, porcini mushrooms, thyme, and tara flour.

The FDA investigation into the cause of the illnesses linked to the French Lentil + Leek Crumbles concluded that the culprit was tara flour. Tara flour is a high-protein flour made from the seeds of the tara plant, which is grown in the higher altitudes of Peru. The FDA found that tara flour can contain a toxin called phoratoxin, which can cause nausea, vomiting, diarrhea, and other symptoms.

As a result of the FDA investigation, Daily Harvest recalled all of its French Lentil + Leek Crumbles. The company also recalled its other products that contained tara flour, including the Chickpea + Quinoa Crumbles and the Sweet Potato + Quinoa Crumbles.

The French Lentil + Leek Crumbles are no longer available for purchase. However, there are a number of other plant-based crumbles on the market that do not contain tara flour. Some popular options include:

Beyond Beef Crumbles
Gardein Beefless Crumbles
MorningStar Farms Grillers Crumbles
Quorn Meatless Ground
Tofurky Italian Sausage Crumbles

These crumbles can be used in a variety of dishes, such as tacos, burritos, pasta dishes, and veggie burgers. They are a good source of protein and fiber, and they can help you to reduce your intake of animal products."
