Plaintiffs claimed that the King Soopers and City Market grocery chains violated Colorado's Unfair Practices Act by selling gas below cost. Plaintifs claimed that Defendants' "Buy Groceries/Get Gas" promotion, consumers using their grocery customer cards could qualify for a discount of 3 cents a gallon. They could get a 7-cent discount if they bought $100 in groceries over 30 days.
Outcome: Plaintiffs' verdict awarding $200,000 in damages.
