Description: New York City, New York defendant charged with murder.
Wayne Gardine was charged with killing Robert Micken, a/k/a "Dak," age 22, on September 3, 1994.
Detectives interviewed two teenagers: a 19-year-old, identified in court papers only as N.S., and his 14-year-old friend, identified as N.V. They claimed that they were close to where the shooting occurred. N.S. identified Gardine after being arrested. He said he had hears that a Gardine was the shooter.
The only evidence available to the State that Defendant committed the crime was a drug dealer who changed his story several times, who described the killer as six feet tall when Gardine is only 5-foot-8, and was know to provideing police with information in attempt to get his own criminal cases minimized.
The investigation of the shooting was seriously flawed.
The detective who investigated the murder later pleaded guilty to a drug trafficking conspiracy.
Outcome: Defendant was found guilty and was sentenced to life in prison.
N.V. and N.S. agreed to accuse Gardine of the murders to appease their own drug boss.
The Legal Aid Society's Wrongful Conviction Unit investigated the conviction of Gardine.
