Case Style: Mark and Rita Bolejack v. Dr. Richard Wolfe and St. John’s Regional Medical Center

Case Number:

Judge:

Court: Circuit Court, Jasper County, Missouri

Plaintiff's Attorney: Roger Johnson, Johnson & Vorhees, Joplin, Missouri

Defendant's Attorney: Randy Cowherd, Haden, Cowherd, Bullock and McGinnis, L.L.C., Springfield, Missouri

Description: Mark and Rita Bolejack sued Dr. Richard Wolfe and St. John’s Regional Medical Center on a medical negligence (medical malpractice) theory claiming that Dr. Wolfe acted below the standard of care while performing a cardiac catheterization on Mark Bolejack in 2006 and, as a direct result, his right femoral artery during the catheterization and discharged him from the hospital prematurely while the condition of his leg was deteriorating from internal bleeding. Plaintiffs sought $5.4 million in past and future damages. Plaintiffs claimed that Wolf negligently injured the artery and failed to recognize the injury he caused in April 2006. They claimed that nurses at the hospital became aware that the patient was bleeding internally after the procedure and paged Wolf, but he did not return to the hospital or respond to the page. Mark suffered permanent nerve damage as a result of the bleeding caused by the femoral artery damage caused by the catheterization.

The defendants denied that they acted below the standard of care.

Outcome: Defendants' verdict.
