Comments: Editor's Comment: News reports about this case indicated that their was the third trial of the damages issue for this case. The first verdict was for $3.6 million, which was reversed on appeal, the second result in a $5.1 million verdict, which was reversed on appeal. The City paid the $3.6 million and the difference between $3.6 and $5.1 million. It now owes the difference plus interest of $3 million. Sometimes is just better to take your lumps and quit.
