Jane Doe sued Jonathan Padilla and Holiday Inn Express civil sexual assault and premises liability theories respectively claiming to have been injured and/or damaged as a direct result of having been sexually assaulted by Padilla will a guest at the hotel in Frazier Park in 2014.
Padilla gained access to the woman's room by posing as the woman's boyfriend to get a key from the front desk.
Padilla was charged and convicted of sexual assault and was sentenced to serve three years in prison and was paroled in 2015.
Outcome: Plaintiff's verdict for $3.5 million with 60 percent being attributed to the hotel employee's negligence and 40% to Padilla, who is judgment proof.
