Description:
Joe Arthur Sims claimed that Louisiana State Police Trooper Barry Ward used excessive force when she forced him to the ground and handcuffed him on June 3, 2000. Ward stopped Sims, an attorney, on suspicion of driving while intoxicated. Sims refused to take a field sobriety test and claimed that Ward flew into a rage. He testified that Ward handcuffed him, then ground his face into a gravel parking lot and stomped on his temple. Ward, on the other hand, claimed that she forced Sims to the ground when he attempted to return to his car to wait for Ward's supervisor to arrive. She claimed that the injuries sustained by Sims were superficial and incident to the take down maneuver. Sims, a former prosecutor in the Tangipahoa Parish district attorney's office, had a blood-alcohol level of between 0.147 and 0.159 two or three hours after his arrest. Sims claimed that Ward beat him after she had handcuffed him.
