James and Annette Lay and others sued Tom Fouts for trespassing on his neighbors' properties and other harassing behavior relating to a dispute over the use of an easement. The plaintiffs claimed that Fouts regularly harassed them by blaring music at all hours of the day and night, trespassing on their property and shining bright lights into the their homes at night.
Fouts claimed that the foundation to a detached garage on the Lays' property caused rainwater to run down onto his property, eroding his lot and hurting his land value. He filed a counterclaim which was ultimately dismissed by the Court before trial
