The parties married in 2011. Mother filed for divorce in March of 2020, and, on May 18, 2020, she filed a complaint in custody seeking sole custody of Children. Father filed a complaint on June 11, 2020, seeking shared custody of Children. On September 16, 2020, the court entered an interim order awarding the parties shared legal and physical custody. On November 20, 2020, Mother filed an emergency petition alleging Father sexually and/or physically abused Children.[1] The court entered a temporary order granting Mother sole custody of Children, awarding supervised physical custody to Father, directing Children continue therapy, and directing DHS to continue an investigation. See Order, 11/20/20.
After several protracted hearings, the court entered an interim order granting the parties shared legal custody, granting Mother primary physical custody, and granting Father partial physical custody. The court also ordered reunification therapy for Father. The order specified that both parents were "fully capable of taking care of the children." See Order, 12/21/21.
On October 26, 2022, the court held another hearing and entered a temporary order. That order provided the December 21, 2021 order remain in effect with some modifications, including requiring the parties to enroll in co-parenting counseling, ordering the parties to take Children to therapy sessions together, and requiring the parties follow the counselors' recommendations. The court also listed the matter for another hearing on March 2, 2023.
Both parties appeared at the March 2, 2023 hearing, each represented by counsel. The court addressed vacation schedules and co-parenting counseling, and scheduled another hearing for October 3, 2023.[2] In the interim, on August 1, 2023, the court issued an order allowing Father to travel with Children for an 8-day vacation to Orlando, Florida. Thereafter, the parties appeared for hearings on October 3, 6, and 12, 2023; Father was represented by counsel and Mother appeared pro se.
