Hladky Construction Inc. sued the City of Gillette, Wyoming for breach of the covenant of good faith and fair dealing relating to a construction contract. The lawsuit arose from a construction project at City Hall in which the building was expanded and remodeled. The work began August 2000 and was finished in August 2002. Plaintiff claimed that the City would not allow it to order precast concrete structures, which delayed the project a year beyond the completion date and increased costs significantly.
The defenses asserted by the City of Gillette are not available.
