Description:
Hess Oil sued Chartis and AIG on bad faith breach of insurance contracts theory claiming that Defendants for failing to pay claims made against the policy for damages associated with an oil spill on Plaintiff's property in 1998. Plaintiff's policy had a limit of $1 million and AIG paid out about $900,000.

Plaintiff claimed that AIG and Chartis intentionally, willfully and maliciously mishandled the insurance claimed filed by it.

Commerce & Industry Insurance Co. and Chartis Claims Inc. claimed that Hess Oil misrepresented the facts in its 1997 insurance application and that the company "duped" Chartis. Romano denies that assertion.
Outcome:
Plaintiff's verdict for $5 million in compensatory damages and $53 million in punitive damages.
