Wheeling-Pittsburgh Steel Corp. sued Massey Energy and Central West Virginia Energy Co. for fraud and breach of contract relating to a coal supply contract. At issue is an agreement between Massey subsidiary Central West Virginia Energy Co. and Wheeling-Pitt for 40,000 tons a month of coal to feed the coke ovens at Follansbee. Wheeling-Pitt was forced to buy coal on the spot market to make up for shortages when Defendant failed to deliver the agreed upon coal.
Massey Energy contended it did not breach the agreement because it provided notification to Wheeling-Pitt of events beyond Massey's control. It claimed that it could not get the coal cars it needed to transport the coal from CSX and unprecedented poor mining conditions.
