The petitioner was eventually apprehended, and, on May 16, 2022, he pled guilty to robbery in the second-degree. The court held a sentencing hearing on July 26, 2022. The petitioner requested a suspended sentence of probation or, in the alternative, home confinement. The State objected to the petitioner's request for alternative sentencing and asked the court for a sentence of imprisonment.
Rule 35(b) of the West Virginia Rules of Criminal Procedure provides that "[a] motion to reduce a sentence may be made, or the court may reduce a sentence without motion within 120 days after the sentence is imposed[.]"
