Description:

Brian Collicott and the family and estate of Branden Atherton sued Chi-Hi, Whole Food Market Group and its driver Michael Kozlowski and Chippewa Trails Bus Company and its deiver Paul Rasmus for the injuries sustained by Collicott and the damages sustained by Atherton's family on their wrongful death claim. Plaintiffs sued on an auto negligence theories claiming that Kozlowski failed to exercise due care in the operation of the truck that he was driving for Whole Foods when his truck and the bus in which Plaintiffs were riding were involved in the collision that injured Collicott and killed Atherton. Plaintiffs claimed that Whole Foods was grossly negligent in its hiring and training of Kozlowski.

Whole Foods and Kozlowski admitted fault.

Outcome:

Settled with Collicott being paid $3 million and Atherton's estate being paid $1.56 million.

Editor's Note: The Atherton's wrongful death claim was apparently capped at $350,000 by Wisconsin law. The suit against Whole Foods was based on respondeat superior and direct negligence.
