Family and Estate of Austin Gagner sued Robert Wellsandt, et al. on an auto negligence theory claiming that Wellsandt failed to exercise due care in the operation of a bus that he was driving and, as a direct result, the bus struck and killed Gagner, age 10, who was riding a skate board through a crosswalk.



Defendants denied fault and further claimed that Austin was more negligent than they in causing or contributing to the accident.
