Description:
Columbia Casualty Co. and other insurance carriers sued Appleton Papers, Inc. seeking a declaratory judgment that they should not be liable for the cleanup on the industrial chemical PCBs dumped into the Lower Fax River by defendant. The U.S. Environmental Protection Agency and state Department of Natural Resources ordered Appleton and other Wisconsin paper companies to dredge and cap PCB-contaminated sediment from the river beginning in 2009. The insurance policies covered 1979-85.
The defenses asserted by Appleton Papers are not available.
