Lillie Lenstrom sued Matthew and Catherine Simpson on a
fraud theory claiming that Defendants engaged in act which were designed to ingratiate themselves with Mrs. Lenstrom and her husband before his
death in order to defraud them of their property.
A social worker concluded that the Simpsons were guilty of elder abuse and had defrauded the Lenstroms. He advised the relatives of the Lenstroms that they should not allow further contact by the Simpsons with the Lenstroms.
Plaintiff claimed that Defendants took advantage of her grieving,
vulnerability, at a time when Ralph Lenstrom (Lillie's late husband) was facing death. She claimed that they induced him to make a gift worth ($750,000) on the representation that they would take care of Lillie Lenstrom.
She also claimed that Defendants conspired to defraud her
by inducing her to sign a contract for the sale of her
farm, a contract that was effectively a gift.
They did so knowing that she was adamantly opposed to the
sale of the farm. She further claimed that Defendants induced her husband to sell personal property worth $160,000 to them for $15,300.
Defendants denied fault.
