The Family and Estate of Harmony Caliman sued Dr. Wayne Lucke on a negligence theory claiming that Defendants committed medical malpractice in 2003 when he cared for and treated Harmony who suffered from meningitis from which she died. Plaintiffs claimed that Lucke acted below the standard of care by not testing Harmony for meningitis and by not prescribing antibiotics to treat the bacterial infection.
Plaintiff claimed that Lucke was negligent in not diagnosing meningitis during Harmony's first three-hour visit to the St. John Medical Center emergency department when she had a 104.3 degree temperature. Lucke's diagnosis was the Harmony had the flu and sent her home. She was brought back to the hospital the same day and died within an hour.
Defendant denied that he acted below the standard of care in his diagnosis and treating his patient.
