Gary Faust sued Bellingham Moose Lodge No. 493 on a Dram Shop claim theory for the injuries and damages that he sustained as a result of an automobile accident involving a patron of the Defendant's bar. Faust was paralyzed from the waist down as a result of spinal cord injuries that he sustained when he was 7-years-old. Plaintiff claimed that lodge bartender served drinks to 57-year-old Hawkeye Kinkaid of Bellingham on the evening of April 21, 2000, even though Kinkaid was intoxicated. Later that evening, Kinkaid's van reportedly swerved into the path of an oncoming car driven by 48-year-old Bianca Faust, Gary Faust's mother. Kinkaid later died in the hospital from the injuries that he sustained in the crash. His blood alcohol at the time was 0.14. Bianca Faust, Bianca Mele and Gary Faust were all injured in the crash.
The defenses asserted by defendant are unknown.
