Negligent infliction of emotion distress claims by Douglas and Allison Moyes against Central Vermont Hospital for disposing of their stillborn fetus' remains was medical waste despite an order that the hospital preserve the remains for burial in a family plot. The dead fetus was delivered vaginally after labor was induced during the 20th week of the pregnancy after it was determined that the fetus had died in utero. The plaintiffs requested in writing that the remains be preserved but the paperwork was lost by the hospital staff with the result that the remains were disposed of as medical waster.
