Martinsville, VA - Jury Convicts Man of First-Degree Murder
The Commonwealth of Virginia charged James Moore with first-degree murder and use of a firearm to commit murder for killing Noel Navarro-Pena, age 33, and Alfonso Navarro-Pena, age 40, in June of 2014. Noel was found dead lying near a pickup in a parking lot near the main gate to the Smith River Sports Complex. Alfonso was found dead in a 1998 Ford F-150 on Daniel Road the same day.
Moore testified on his own behalf and denied killing the men.
Co-defendant Jonathan Rivera-Oliver testified for the Commonwealth and said the killings were over drugs.

Virginia Criminal Code Section 18.2-32 provides:
First and second degree murder defined; punishment
Murder, other than capital murder, by poison, lying in wait, imprisonment, starving, or by any willful, deliberate, and premeditated killing, or in the commission of, or attempt to commit, arson, rape, forcible sodomy, inanimate or animate object sexual penetration, robbery, burglary or abduction, except as provided in ยง 18.2-31, is murder of the first degree, punishable as a Class 2 felony.All murder other than capital murder and murder in the first degree is murder of the second degree and is punishable by confinement in a state correctional facility for not less than five nor more than forty years.
