Description:

Nursing home negligence - Parkinson's patient, age 84, was admitted to defendant's nursing home facility for swallowing therapy. The patient died an hour after breakfast and 20 minutes after vomiting. No food or obstrucvtions were allegedly found in the decedent's airway and the death certificate stated that the cause of death was respiratory arrest secondary to aspiration. Plaintiff claimed that the decedend choked to death because he was not properly monitored while eating and after vomiting. Defendant claimed that decedent died from cariopulmonary arrest and that there was no evidence of airway obstruction.

Defendant's verdict.
