Description:
Automobile pedestrian accident in which the defendant, who was driving while intoxicated, drove onto the sidewalk, where the plaintiff was doing landscaping work, and hit the plaintiff twice before leaving the scene of the accident. Plaintiff sustained severe brain damage including pituitary gland damage. He also loss all his sight in one eye and partial loss of sight in the other. His medicals were $380,600 and his future medicals were estimated to be about a million dollars. He was 25-years-old at the time he was injured and was earning about $30,000 a year as a landscaper.
The insurance company for the pickup the defendant was driving denied that the defendant had the permission of the owner to drive the vehicle.
Outcome:
