Marty Hierholzer ("Hierholzerâ€) is the sole owner, president, and chief executive of MJL Enterprises, LLC ("MJLâ€) (collectively "Appellantsâ€). Appellants allege that the Small Business Administration's ("SBAâ€) Section 8(a) Business Development Program ("8(a) Programâ€) discriminated against Hierholzer based on his race. The 8(a) Program
employs a race conscious, rebuttable presumption allowing members of certain racial and ethnic groups to establish that they are "socially disadvantaged.†13 C.F.R. § 124.103(a).
Reversed in part and affirmed in part.
