The outcome was: Viewing the facts in the light most favorable to the proponent of the voluntary manslaughter jury instruction, there was credible evidence that Dandridge was provoked to fear or anger, or both, by the victim’s initial attack in the car and Dandridge’s perception that the victim was coming to attack again. The trial court should have instructed the jury on voluntary manslaughter as Dandridge requested, and it was the jury’s purview to determine if the last shot fired was done so with malice or with heat of sudden passion. We reverse the convictions and remand for a new trial if the Commonwealth be so inclined.
