Description:

Dram Shop - Plantiff was stopped in traffic when he was rear-ended by a vehicle driven by Carl McClendon. McCledon left the scene and was arrested shortly thereafter for driving while intoxicated. His blood alcohol level was almost twice the legal limit. At the time of his arrest, McClendon stated that he had been at Galaxy Billiards. McClendon stipulated to liability and intoxication.

Outcome:

Jury found no negligence against Defendant Galaxy Entertainment, Inc. Jury found negligence and gross negligence against Defendant Carl McClendon. Jury awarded $20,000.00 in actual damages and $7,500.00 in exemplary damages.
