Jessica Volz sued Kevin David on an auto negligence theory claiming to have been injured as a direct result of a car wreck caused by David while intoxicated. Plaintiff claimed that Davis, age 29, drank half of a bottle of Southern Comfort over a 30-minute period on November 25, 2008, waited 10 minutes, then drove down Mountain View Road. He passed out and drifted into the oncoming lane and struck Volz' car head on. Volz, age 18, was returning home from a basketball game.
The defenses, if any, asserted byu David, who had three previous DUI convictions, was charged, convicted and sentenced to four-years in prison.
