Glenda Ann Nixx, age 58, sued BP Chemical on a negligence theory claiming that she sustained disability injuries to her feet when she tripped and fell while walking out of a portable toilet in 2005. She claimed that an improperly installed grate outside the toilet near the BP Chemical docks in Galveston. She claimed that she was no longer able to work as a security guard after the injury and was reduced to driving school buses to make a living.
