Description:

Linette Weller sued Texas Department of Criminal Justice claiming that it retaliated against her and then fired her in 2001 for seeking an accommodation for her disability after the department began using an aerosol room deodorant in its offices at the Sanchez unit that triggered her asthma and put her in the hospital. She claimed that the defendant kept installing the aerosol room deodorant units in her office despite repeated requests that the devices not be installed. She claimed the state failed to provide a reasonable accommodation for Weller's disability, caused her unnecessary hardship and failed to deal with her in good faith.

The defenses asserted by the State of Texas are not available.
