On April 25, 2014, three 911 hang-up calls were received from an upholstery business, and officers were dispatched to the location.4 When Officer Brian Turner arrived, he found the Defendant's mother outside. Her hair, neck, chest, arms, and hands were covered in transmission fluid.
The Defendant then appeared outside and called his mother a "black widow†and a "drug dealer.†Defendant retreated inside to an office when Officer Turner tried to talk to him. Officer Braan arrived, and his car began recording video. On the video (at about the 1:16 mark), an officer could be heard saying, "Come on out of there.†This command was repeated three more times, but Defendant did not comply. Officer Turner entered the office and discovered that transmission fluid was "all over†the office, including the floor.
Five different times, an officer said, "Put it up.†(1:40) That command later changed to, "Put it
down,†and was issued five times. Defendant said, "I don't want to die.†Then,Defendant said, twice, "I got a lighter.†Afterwards he said, "You're going to blow us up.†Later, he said, "You're going to kill everybody.†(3:08) Then an officer commanded, eight times, "Put the lighter down.†Defendant responded with, "You going to kill all of them,†and, "You're going to die—everybody in this goddamn building.†(3:39, 3:46) An officer asked, "Are you going to give up or not? †Defendant responded, "You're going to die, motherfucker.†He followed up by saying, "We're all going to die.†At some point, Defendant's mother showed up at the doorway and said, "You're going to kill him.†(5:42) Appellant responded,
"They're beating me up, Mom.†Later, an officer ordered Defendant to, "Put your hands behind your back.†This order was issued four times, and Defendant said, "No,†at least twice.
About a minute later, an officer ordered Defendant to, "Put the screwdriver down.†Appellant
would later deny on the recording that he used a screwdriver.
The Defendant was charged with multiple offenses, but the only one at issue here is assault on a
public servant for biting Officer Turner.
The Defendant claimed that he acted in self defense.
