Description:
Products Liability - Personal Injury - Design Defect - Negligence - Plaintiff sued manufacturer of a guide wire, Eli Lilly, used in an angioplasty procedure for defective design. During plaintiff's angioplasty procedure, the guide wire fractured and caused palintiff to need bypass surgery. Plaintiff also claimed that Advanced Cardiovascular systems , Inc., was negligent in the use of the guide wire during the procedure. Plaintiff sought $42,000.00 in medical expenses and $20,000.00 in lost wages. Defendants asserted that a guide wire fracture is a forseeable complication associated with angioplasty procedures which was warned of in the inserted data sheet with the product, and that the design was not defective.
