8 U.S.C. § 3146(a)(1) is a section of the U.S. Code that defines the crime of
failure to appear, which is committed by anyone who knowingly fails to appear in court as required by the conditions of their release. To be found guilty, the government must prove the defendant was released, had a required court appearance, knew about the requirement, and intentionally failed to appear.

Punishment

If the underlying offense was punishable by death, life imprisonment, or a term of 15 years or more, the penalty is a fine or imprisonment for up to 10 years, or both.
Other punishments vary based on the underlying offense, with punishments ranging from a fine and up to one year in prison for a misdemeanor, to a fine and up to two years in prison for other felonies.
