Newcomer sued Armstrong World Industries, Inc. on negligence and respondeat superior theories claiming that Armstrong's truck driver failed to exercise due case and, as a direct result, Armstrong's truck knocked her over and ran over her left leg and hip. As a result of the injuries that she sustained, Newcomer's leg was amputated and she underwent a hemipelvicectomy. She was 43-years-old at the time and incurred about $500,000 in medical expenses and lost $900,000 in income.
Defendant denied that the truck ran onto the sidewalk and claimed that Plaintiff rode here bicycle into the street and crashed into the truck.
