Description:
Medical malpractice claim by former patient of East Stroudsburg, Pennsylvania surgeon Dr. Bois Paul who was told by Dr. Paul that he had performed an appendectomy on the plaintiff when, in fact, he had not done so. Breen, 42, an electrician who lives in Stroudsburg, suffered his first attack in January of 1999, and Dr. Klein performed a laparascopic appendectomy. Breen was hit with another acute stomach pain attack in May of 1999. This time Dr. Paul did open exploratory surgery on Breen's abdomen and found a 1½ inch perforated appendix and extensive infection in Breen's abdomen.
Outcome:
The jury awarded Breen $60,000 for pain and suffering, $14,066 for medical expenses, and $7,187 for lost wages. Linda Breen was awarded $5,000.
