Description:
The defendants own land located along the Columbia River Highway and operate a business selling and servicing motorcycles and other products.The plaintiffs condemned the defendants property and obtained easements over the land to allow workers from the Oregon Department of Transportation to widen the highway near the defendant's business. During the road work, it was determined that the ground was contaminated with hazardous materials and that neither party was aware of this fact prior to the condemnation action being filed.
Outcome:
Trial court had awared damages and costs and attorney fess. This was overturrned upon appeal.
