Description:
Civil rights, wrongful death claim, by the family of Vernard "Vandy'' Davis who was shot to death by Rochester, New York police officer David Gebhardt in 2001. The family claimed that officer Gebhardt used excessive force and that Rochester's policies contributed to the death of Vandy, age 21. Gebhardt claimed that the shotgun that he was carrying accidentally discharged when he pointed the weapon at Davis in order to illuminate him with a flashlight attached to the gun barrel. The officers who entered the Davis house on Joseph Avenue unannounced had the safety catches on their weapons in the fire position. The City claimed that Gebhardt's finger was not on the trigger when it discharged shooting Davis in the chest. The claim was that the gun discharged when the trigger brushed against the officer's bulletproof vest.
