Description:
Claim against State of New York for negligent misrepresentation wherein state agency provided erroneous environmental emissions data to plaintiff power plant developer, plaintiff relied on the accuracy of that data in apply for necessary permist to construct coal-fired power plant, and to meet on-line deadline in long-term power purchase contract with utility. Consequently, plaintiff failed to obtain permits, missed deadline in power purchase contract, and lost in excess of $40 million invested in reliance on the accuracy of the data, as well as profits from power purchase contract.
Outcome:
Settled for $29 million.
