State of New York v. Eric Frazier

Albany, New York, criminal defense lawyer represented the Defendant charged with one count of Aggravated Assault on a Police Officer with a Deadly Weapon and one count of Attempted Aggravated Assault on a Police Officer with a Deadly Weapon.



"In spite of the officers' attempts to de-escalate the situation, Eric Frazier, age 57, chose to launch a violent attack that day,” DA Kindlon said. "And when the facts of this case are laid out, there's solid proof to show that the officers on scene that day prevented a violent attack from turning deadly.”



On June 20, 2022, Albany Police responded to a call on Franklin Street reporting a physical altercation between Frazier and his former partner. When officers ran a background check on him, they discovered he had an open warrant for a previous assault on another woman.



Officers informed Frazier that they would have to take him into custody, and when they tried to handcuff him, Frazier pulled a knife and attempted to stab one officer in the chest and slashed another officer in the arm, causing serious physical injury.



Frazier continued to swing the knife and only stopped when an officer discharged his firearm, striking him in the chest. Officers treated Frazier on scene and he was transported to Albany Medical Center Hospital.



Assistant District Attorney Ariel Fallon of the Special Victims Unit and Trial Assistant Ashley Rizzo prosecuted the case.

The Defendant pleaded guilty. Frazier, whose jury trial in the case was slated to start Oct. 14, will be sentenced to serve 17 years in state prison followed by five years of post-release supervision when he is due in court on Dec. 8.
