Description:
Albuquerque Tortilla Company sued Jaynes Corp. on a negligence, breach of contract and breach of fiduciary duty theories claiming that the construction of an addition to its bakery in 2006 caused mold to be found leading to a succession of problems for the family-owned food business. ATC claimed that the mold problem was hidden from it by Jaynes' employees.
ATC's owner claimed that they were forced to sell the company as a direct result of the problem created by Jaynes.
Jaynes admitted that was at fault but claimed that that it told ATC about the problem but claimed that ATC failed to mitigate the damages sustained by it.
